Parents win wrongful death lawsuit against driver, state

Approximately two years ago, two children were killed in Ascension Parish when an SUV left a road and crashed into them.

Although it took several years for the children’s parents to gain closure, they were recently awarded a $4.4 million judgment against the driver of the vehicle as well as the state.

On June 24, 2014, the two children, along with their father and several other adults, were fishing in a local body of water. According to state police, a 47-year-old woman ran her SUV off the road, slid down a large embankment, and crashed into the entire group.

While the three adults were treated at a local hospital, the two children were both killed in the accident.

A jury recently returned a verdict that awarded the parents more than $4 million. The payment will be made by the state and the driver’s insurance company. The jury also found that the woman was responsible for 40 percent of the damages with the state responsible for the rest.

The lawsuit claimed that the maintenance and negligent design of the road, with its S-shaped layout, was partially to blame for the death.

Along with the $4.4 million to the children’s parents, another person who was injured in the accident was awarded approximately $1 million in damages.

These are the types of accidents that nobody sees coming, but can have a major impact on the lives of those involved.

It’s never easy to deal with the death of a loved one. If this happens as the result of another party’s negligence, the end result could be a wrongful death lawsuit.
