Should you settle your car accident claim?

Most people who are injured in a car accident simply want financial stability while they focus on their recovery. A little sense of accountability doesn’t hurt, either. This sometimes drives car accident victims to jump on settlement offers before fully vetting them to determine if they are as favorable as possible. Don’t let that happen to you.

You might be able to increase your recovery if you thoughtfully analyze your case and your settlement offer and act accordingly. Here are a few ways to go about assessing your case.

Know your losses

You can’t realistically say if a settlement offer is appropriate if you don’t know the value of your case. So, you’ll want to try to put a number on your medical costs, rehabilitation expenses, lost wages, and pain and suffering. This can be difficult to do, though, so you might want to find some assistance here.

Consider strengths in light of weaknesses

The chances are that your case has strong points and weak points. By thoroughly assessing both you can gain a more realistic picture of your likelihood of success at trial. This can also give you leverage during negotiations and steer you in the right direction as far as accepting a settlement offer is concerned.

Look at how similar cases have been handled

While no two cases are the same, there are usually similarities between multiple cases. This means that you can analyze how juries have responded to cases similar to yours, which can be informative in how you should act when negotiating.

Consider what goes into litigation

Litigation is often a drawn out and stressful process. While it can certainly be worth it, oftentimes leading to a larger recovery, there’s also some risk involved. So, you’ll want to consider how badly you want to hold out, or if you think it’s better to just take a settlement and move on.

Dealing with a personal injury case can be confusing, frustrating, and overwhelming. Yet, you don’t have to face your legal challenges alone. Instead, you can have a competent legal advocate on your side who can help you navigate your case toward what is hopefully a favorable resolution, whether that comes through skillful negotiation or aggressive litigation.
