Truck driver’s failure to yield kills motorcyclist

Experienced motorcyclists understand that they expose themselves to additional risk by choosing to travel on heavily traveled main highways. By choosing such routes, a motorcyclist must be careful to exercise extra vigilance and be extra aware of their surrounding and any vehicles that are sharing the road. A recent accident on Airline Highway in Prairieville demonstrates the extreme hazards that motorcyclists face.

The accident

According to police, the accident occurred at about 5 p.m. on Airline Highway just north of Swamp Road in Prairieville. The initial police investigation revealed a northbound Ford F-150 heading north on Airline Highway. A motorcycle driven by a 35-year-old man was heading south on Airline Highway riding a Kawasaki. The truck driver wanted to make a left turn across the southbound lane. Instead of yielding the right-of-way to the motorcycle, the truck turned on Swamp Road directly into the path of the motorcycle.

The motorcycle struck the truck just behind its passenger door. The driver of the truck was wearing a helmet and was properly restrained. He received only minor injuries and was treated at a nearby hospital. The rider of the motorcycle was wearing a helmet, but he nevertheless died from his injuries.

Police are continuing their investigation of the circumstances and causes of the accident. One additional focus of the investigation is a toxicology check to determine if either driver may have been intoxicated.

The consequences

In similar accidents, the family of the victim will want to explore the possibility of bringing a claim for wrongful death against the driver. In order to succeed in such a claim, the family members must prove that the actions of the defendant were “wrongful.” Wrongful in this context is synonymous with negligent.

The initial police report of the accident on Airline Highway appears to indicate that the truck driver was negligent in failing to yield the right-of-way to the motorcycle. In such cases, the advice of an experienced accident attorney can provide valuable assistance by evaluating the evidence, suggesting various legal arguments to establish negligence, and providing an estimate of the likelihood of recovering damage for financial support and loss of love and comfort.
