Know your losses


You can’t realistically say if a settlement offer is appropriate if you don’t know the value of your case. Consider strengths in light of weaknesses


The chances are that your case has strong points and weak points. By thoroughly assessing both you can gain a more realistic picture of your likelihood of success at trial. This can also give you leverage during negotiations and steer you in the right direction as far as accepting a settlement offer is concerned.


Look at how similar cases have been handled


While no two cases are the same, there are usually similarities between multiple cases. This means that you can analyze how juries have responded to cases similar to yours, which can be informative in how you should act when negotiating.


Consider what goes into litigation


Litigation is often a drawn out and stressful process. While it can certainly be worth it, oftentimes leading to a larger recovery, there’s also some risk involved. So, you’ll want to consider how badly you want to hold out, or if you think it’s better to just take a settlement and move on.
