Wrongful death refers to a situation where a person dies because of the negligence or intentional act of another. Louisiana wrongful death cases may arise from a variety of situations, including:

In Louisiana, wrongful death actions must be filed by the person or persons designated by law as the proper beneficiary. It must be filed within one calendar year of the date of the death. If the deceased person leaves behind a spouse and/or children, they have the first right to bring wrongful death actions. If there is no surviving spouse or children, the person’s parents have the right to bring an action for their child’s death. Lastly, if there is no spouse, children or parents, then the living siblings of the deceased have the right to bring actions for wrongful death.
