Filing Action For Wrongful Death In Louisiana
In Louisiana, wrongful death actions must be filed by the person or persons designated by law as the proper beneficiary. It must be filed within one calendar year of the date of the death. If the deceased person leaves behind a spouse and/or children, they have the first right to bring wrongful death actions. If there is no surviving spouse or children, the person’s parents have the right to bring an action for their child’s death. Lastly, if there is no spouse, children or parents, then the living siblings of the deceased have the right to bring actions for wrongful death.
The claim seeks compensation for financial losses (known as loss of support) and the loss of love, affection, services and companionship of the deceased. Negligent death recovery may also include medical costs and funeral expenses.
There are two essential elements to a successful wrongful death claim: proving the liability of the negligent party, and demonstrating the full extent of the loss to survivors. Our experienced Louisiana wrongful death lawyers will prepare your case for presentation to a jury by thoroughly examining the evidence, identifying possible sources of compensation, interviewing witnesses and assembling a powerful team of experts and legal professionals to support your case.
It is also very important to know why your loved one died. Many times, the cause of death is obvious. Sometimes an autopsy must be performed to determine the cause and manner of someone’s unexpected death. You should always agree to do an autopsy if one is suggested by your loved one’s treating physician or the local coroner.
